Added 03/02/25These terms may be altered and updated at any time.
Updates to the TOS will have to be accepted to continue to use the artist's works and services.
[General] ◈ [Process] ◈ [Payment]
[Copyright] ◈ [License] ◈ [Violation of TOS]
The following terms apply to the artist's works between you, the customer, and I, the artist.By inquiring about commissioning the artist and claiming a commission slot,
the customer had read, understood, and agreed to the Terms of Service. The customer must be at least 18 years of age or older to commission the artist. These services are for individuals only, NOT companies. These services are NOT works for hire, and are NOT for profit,
AI, NFT, Crypto, blockchain, etc. NO EXCEPTIONS.The artist retains the right to refuse a customer, cancel commissions,
or revoke a customer's rights to the artist's works without needing to provide a reason for doing so.
◈ Preparation
Before the a commission, the customer must do the following as the artist will not accept commissions any other way:
━ Have an email to contact the artist with.
━ Be prepared to receive and respond to the artist's messages within a reasonable time.
━ Have the full payment for the commission available and at the ready at all times.◈ Claiming a Slot
If there is an open commission slot on the artist's Trello board found in the links tab above, the customer can contact the artist via email to claim a slot.
━ The commission slots are first come, first serve, however if a customer has very recently commissioned the artist and there are other customers in line, the next customer may be selected instead to offer others a chance.
━ The time limit to respond to a confirmation is 48 hours otherwise the customer will have to return to the queue.◈ Commission Form
After the commission slot has been claimed, the artist will contact the customer to discuss the details of the commission itself. This will be done via email, and a form will be sent for you to fill out to cover the basic information. A link to the TOS will also be sent for the customer to agree to so the services may be used by the customer.
━ If the customer has any questions, they may be added them at the end of the form.
━ The time limit to fill out the commission form is 48 hours otherwise you will have to return to the queue.
━ The artist will then look over the form once it has been returned and will ask the customer for any clarifications if needed.◈ Payment (See next section)
If there is nothing left to discuss about the commission and the details have been agreed upon, a Stripe invoice will be sent to the customer through the customer's email.
━ The customer is expected to pay for sketches in full up front.
━ If the customer has a larger commission, the customer will have to pay for rest of the commission once the sketch phase has been completed.◈ Work In Progress
When the invoice has been paid, the artist will then begin on the customer's commission. No work will begin until it has been paid.◈ Progress Updates
These will be given to the customer via email at the end of each step of the commission as progress checkpoints. This is so that any corrections or adjustments can be made.
━ Once the progress has been approved, the artist will then proceed to the next stage of the commission. This will repeat until the commission is completed.◈ Finished Product
Once the commission is completed, the customer will be sent a high-resolution image for personal use via email (with possibly a redirection link if the file is too large) as well as a lower-resolution web version for public use. Both will be JPEG files. The customer will also receive a link to the speedpaint if one was made.
◈ Payment Method
━ All prices are listed in USD.
━ An invoice will be sent to the customer through Stripe via email once the commission has been accepted and the form has been filled out with the details agreed upon.
━ Stripe should be able to automatically convert your local currency into USD. If it doesn't, the customer will have to pay in USD as other currencies are not accepted.
━ There will unfortunately be an Stripe service fee of 2.9% of the overall commission price plus 30¢ added to the commission's overall price.
━ The base commission prices do NOT include the Stripe service fee and should instead be listed in the invoice.◈ Sketches and Mini Commissions
For sketches, full pay is due up-front with Stripe within 48 hours of having the commission form finalized with an invoice being sent to the customer via email.◈ Illustrations and Renders:
For commissions that involve work beyond a sketch, the commission must be paid in two parts.
━ Payment for the sketch phase of the commission is due up-front within 48 hours of having the commission form finalized with an invoice being sent to the customer via email.
━Once the sketch phase has been completed, the customer must pay for the rest of the commission within 5 days◈ Payment Plans and Upgrades
If a customer would like a commission but cannot afford to pay it up front at once, a payment plan can be agreed upon where the artist can be paid by each progress checkpoint completed (sketch, inking, coloring, etc.) and then by chunks for larger rendering projects (character, clothes, items, foreground, background, etc.)
━ The customer will have to re-enter the queue for when they are ready and able to pay for the next checkpoint.◈ Refunds
No refunds will be issued unless no progress has been made on the commission after a month due to either no response from the customer for progress checkpoints, or if the artist personally decides to cancel the commission for any reason.
━ The refund amount will be for the remainder of the work that has not started.
━ Completed work or work that has been half-completed will not be refunded.◈ Chargebacks
If the customer decides to go through with a chargeback as allowed through Stripe service, the customer may be blacklisted from the artist's services and reported to Artists Beware depending on the circumstances.◈ Additional Charges
Some adjustments, extra details, complexity, or subjects that the artist finds more difficult but are willing to work with may incur further charges, especially if the commission is further along in the rendering process.
━ This can be discussed as minor adjustments (base color, changing eye shape, etc.), especially before progress is made beyond the sketch phase, tend to not affect this.
━ The additional charges may range anywhere from an extra $10 to $100 and do NOT include the Stripe service fee.
◈ The artist is comfortable with works involving the following:
━ Organic subjects (Animals, anthropomorphs, ferals/furries, alien/supernatural/unnatural entities, humanoids)
━ Sketches, lineart, and flat colors◈ The artist is relatively decent with the following subjects and may include slightly higher charges depending on complexity:
━ Humans
━ Insects
━ Plants
━ Natural inorganic matter such as rocks, cliffs, mountains, etc.
━ Natural landscapes
━ Organic-looking synthetic/robotic lifeforms
━ Organic-looking dwellings
━ Certain visual perspectives
━ Simpler rendering such as anime or comic styles◈ The artist has great difficulties with the following subjects which will incur additional charges and may result in lower quality work due to inexperience and the extra time and effort it will take to create works including these:
━ Inorganic subjects, including but not limited to synthetic/robotic entities, machinery, mechs, vehicles, buildings, cityscapes, scientific/sci-fi displays, etc.
━ Higher-end or semi-realistic rendering.
━ Commissions with time limits (these will more than likely be turned down)◈ The artist refuses to do works involving these subjects and may blacklist customers who request the following:
━ Fetishes or pornographic/sexual content
━ Sensual depictions of minors (under 18 years of age) including any characters that may be interpreted as a minor
━ Content that may be determined to be discriminatory or hateful (works of fiction, i.e. warring alien species, may be exempt- discuss with artist)
━ Content deemed illegal to the USA, including copyright infringement
◈ Copyright Ownership of Works
━ The copyright ownership of all works done by the artist belongs to the artist as their author. This includes commissions.
━ The customer is only granted a license to the works, which limits what the customer can do with the works even if it is a physical object within their possession after purchase.
━ New content developed within the commission invented and created by the artist for the customer are owned by the artist as the author, which includes but is not limited to new fictional species.
━ This does NOT include content that is intellectual property of the customer that they are the author of prior to commissioning the artist, or intellectual property which has had the copyright ownership transferred to the customer from the previous owner.◈ Rights of the Artist Regarding Their Works
The artist reserve the right to:
━ Publicly display their works.
━ Alter their works.
━ Make derivatives of their works.
━ Create, distribute, and/or sell copies of works.◈ Protection of the Customer's Intellectual Property
━ Should the artist plan to create, distribute, and/or sell copies of a commission, the artist will respect the customer's own intellectual property by making a second alternate version of the original commission with the customer's intellectual property removed so it does not violate the customer's copyrights.
━ If the artist does not feel any alterations to the work is possible, the artist will ask if the customer would instead be comfortable with and willing to allow the artist to create, distribute, and/or sell copies of the original commission so long as the customer is credited as the owner of the intellectual property represented within the works. In this case, the customer will be given a single free copy of any product made with their intellectual property present in the works.
All licenses give the customer limited rights to the artist's works.
These apply to all commission types unless listed otherwise below.
◈ All Works
━ The customer is not allowed to alter, make derivatives, create, distribute, and/or sell copies of the artist's works.
━ Only the finished product is for the customer. Works in progress are not for personal use or public display by the customer unless the artist gives permission. This includes livestreams and works in progress sent to the customer.
━ Only the low-resolution web files provided by the artist may be publicly displayed.
━ Only the low-resolution web file may be resized or cropped for public social display such as profile images and banners so long as the artist is credited either in the customer's profile or bio if it's used as profile image, or in the post or page that the image is displayed on.
━ The customer may not post the artwork in any way that may be deemed harmful to the artist's public image or place the artist in a bad light.
━ The high-resolution file of the commission is for personal use only (i.e. backgrounds, screensavers, etc.) and is not for public display.◈ Adoptables
The customer has limited rights to how purchased adopts (i.e. custom characters from custom or pre-made species) are used:━◈ Pre-made
The customer has limited rights to pre-made works such as carvings, sculptures, prints, and stickers:━◈ Tattoo Designs
The customer has limited rights to works involving custom and pre-made tattoo designs:━ Tattoo designs are NOT free to use and MUST be purchased before being applied. Only ONE use per purchase is allowed.
━ IT MUST BE MADE CLEAR TO THE TATTOOIST THAT THE TATTOO DESIGNS ARE TO NOT BE RE-USED BY THE TATTOOIST. Tattooists must be told that if they wish to use the design for their other customers, they must speak to the artist to purchase copies of the design themselves to apply it to customers, or that their future customers must purchase a design from the artist. If they fail to do so and continue to apply copies altered or otherwise to other customers, it is legally considered theft and copyright infringement as they are not the original author of the works and are making a profit from the work of others.
━ Because of their nature, tattoo designs are allowed to be publicly displayed once applied by a tattooist.
━ If the tattoo is displayed online with the tattoo as the main focus, credit must be given to the artist in the post's description. If it is not the main focus of a photograph (i.e. it is simply showing in a group photo), credit is not required to be given unless a viewer asks for the artist of the tattoo design.
IF ANY OF THESE TERMS ARE VIOLATED,
THE ARTIST HAS FULL RIGHTS TO REVOKE THE CUSTOMER'S RIGHTS TO THE COMMISSION(S) AND DENY FURTHER SERVICES.

This is all I'll provide for context about myself.
Please understand and respect this.
I am not terribly active on social media and because of this my activity, especially on the art-related platforms, tend to be lacking.
Hopefully this will change as I do more work as I've recently just begun my services.
I will attempt to hold consistent livestreams when I am actively working on artwork,
and if I'm feeling sociable, videogames on occasion. Speedpaints will also be posted to my YouTube.
